General Terms and Conditions (GTC) – StickFix

1. Scope

These General Terms and Conditions (GTC) apply to all contracts, deliveries and services of StickFix – controller and console repairs, upgrades and modifications – with private and business customers in Germany, Austria and Switzerland.

2. Services

StickFix offers repairs, upgrades, visual adjustments, and maintenance for controllers and consoles, including stick replacements, trigger modifications, mechanical buttons, various soldering services, liquid metal replacement, and custom design adjustments, among others.

3. Conclusion of contract

A contract is concluded when StickFix accepts a customer request – in writing, by email, by telephone or in another form.

4. Prices & Payment Methods

All prices are in euros including VAT (where applicable).

Payment methods: cash, bank transfer, debit card.

5. Handover & Shipping

Collection and handover are possible on site at the specified times.

Shipping takes place within Germany, Austria, and Switzerland. Shipping costs are borne by the customer unless otherwise agreed. The buyer bears the shipping risk, to the extent permitted by law.

6. Processing time

Repairs and upgrades are typically completed within 1-3 business days of receiving the device, provided all required parts are available.

7. Warranty & Guarantee

The statutory warranty applies. In addition, StickFix provides a voluntary warranty of 6 months from the date of delivery on repairs performed and parts installed.

The warranty excludes: damage caused by improper handling, external influences, normal wear and tear, and modifications by third parties.

8. Right of withdrawal

Private customers have a statutory right of withdrawal of 14 days, with the exception of individually manufactured or modified devices, as these are manufactured according to customer specifications (§ 18 FAGG / § 312g BGB).

9. Liability

StickFix is only liable for damages caused by intent or gross negligence. No liability is assumed for:

• Data loss

• Consequential damage due to improper use

• Damage that already existed before handover

10. Retention of title

The goods remain the property of StickFix until full payment has been made.

11. Place of jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Vienna, to the extent permitted by law.
